Last year, Malaysian restaurant chain Mamak were fined almost $300,000 for paying their workers just $11 per hour. Now, they’re facing legal action for the second time after allegedly underpaying their staff.

It is alleged that two Sydney employees were deliberately underpaid, and false records were kept to cover up the short-change. The Fair Work Ombudsman is taking the operators of Mamak to court over the matter.


It is claimed that the two workers were paid $12 and $12 per hour between 2014 and 2016. One of the employees was an Australian citizen who worked as a waiter, the other a waitress from Singapore who was on a temporary visa.

The individuals face penalties of up to $10,800 per violation, and the business it self faces penalties of up to $54,000 per violation.

The hearing is set to take place in the Federal Circuit Court in Sydney on June 20.
