Making A Murderer’s Steven Avery Wins Appeal, Could Have New Trial

There has been a development in the case of Steven Avery, whose murder conviction has been the subject of the Making A Murderer Netflix documentaries.

Mr Avery is set to have his case re-examined by a Wisconsin circuit court, after a motion was won to appeal.

He was found guilty of the murder of Teresa Halbach in 2007, and has been pushing for further appeals to the conviction since.

His lawyer, Kathleen Zellner, told Newsweek that the victory is a huge step in her client's case.

"The appellate court granted our motion to supplement the record with the evidence the bones were destroyed," she said.

"The case is being remanded back to the circuit court to conduct proceedings, which can include a hearing.

"The circuit court can grant a new trial, or if not, back to appellate court who can reverse the conviction and/or grant a new trial.

"Either way, the State opposed this motion and lost. This evidence has the potential to undo the whole case, so it is a big win."

It is understood that the appeal is based on evidence, with Ms Halbach's bones returned to her family before they could be properly tested.

In terms of what this means for Avery's case, the evidence surrounding the bones can now be submitted, and could result in a second trial of the matter.

Season two of Making A Murderer detailed Ms Zellner's alleged discovery of additional evidence which she claims could change the outcome of the case.
