They have under 900 Instagram followers and almost no money to their name. Band 'Ruby Tuesdays' who hail from Figtree just near Wollongong have been slapped with a $2 million lawsuit from huge US restaurant chain 'Ruby Tuesday'.

The band who recently formed late last year have performed sell out shows and were shocked to receive a cease and desist letter from the lawyers of the restaurant chain.

"The company want the turnover and the destruction of all of our merchandise and money made from our merchandise and albums," guitarist Shaun Snider told the ABC

The name for both the band and the restaurant chain come from the Rolling Stones Song 'Ruby Tuesday'. So the name isn't originally from the US company.

Copyright expert Michael Handler told the ABC, "Often the tactic that is used by big owners of brands is to send a threatening letter in the hope that the other side will just fold, rebrand or just change it's name."

The four piece band have so far spent $13,000 making their dreams a reality. The boys say they won't be changing their name.
